If any question arises as to what, in any particular case, is or is not development, or is or is not exempted development within the meaning of the Planning & Development Act 2000, any person, may on payment of the prescribed fee of €80.00, request in writing from Kilkenny Borough Council a declaration on that question and that person shall provide any information necessary to enable the authority to make its decision on the matter.
The Planning Authority must make a decision within 4 weeks of receipt of application.If the applicant does not agree with the Planning Authority's decision, same can be appealed to An Bord Pleanála.
In order to apply for a Section 5 Declaration, please submit:
- Completed application and additional necessary documentation- Location Map- Fee of €80.00
